Helping Families Plan for MassHealth Eligibility

Medicaid, known as MassHealth in Massachusetts, is a program which, among other things, funds long-term nursing home care. Planning can help elders preserve and protect assets from nursing home costs. Various strategies are available to shelter the primary residence and other assets from consideration when applying for Medicaid benefits. It is a good idea to plan for Medicaid eligibility or at least educate yourself about the advantages and disadvantages of doing so before a crisis occurs. Considering ever-increasing costs of nursing home care, decades of savings could be depleted in months. With that said, our law firm can take steps to help protect a family's assets while obtaining Medicaid eligibility.

Obtaining Guardianships and Conservatorships for Vulnerable Adults

A portion of our elder law practice involves establishing guardianships and conservatorships for elderly adults who are no longer able to manage their affairs. Our law firm regularly advises adult children who are concerned that their parents are no longer able to stay in the family home or care for themselves. In some cases, family members are seeking to assist family members who, due to a dementia-related or other debilitating illness, are no longer able to make financial or medical decisions for themselves. In many cases, family members are seeking to have loved ones admitted to nursing homes, assisted living facilities or other supported living options, but simply lack the legal authority to do so. Our attorneys also represent family members of vulnerable adults requesting a guardianship or conservatorship before the court.
